South Dakota’s timeshare laws are controlled through Statute 43-15B which is titled “Time-Share Estates”. South Dakota Timeshare Cancellation

20:69:12:21: South Dakota, timeshare law declares that purchasers have a seven day right of rescission to cancel a time share contract. This “cooling off” period begins once the timeshare contract has been executed or when the purchaser has received the disclosure statement.

In South Dakota the purchaser must send a written notice to cancel the timeshare to the purchaser within this time period for a refund of all fees within 30 days.

Time Share Sales Laws in South Dakota

Under 20:69:13:02 any timeshare sales agent shall not sell or offer any timeshare contract without proper licensing.

Timeshare Advertisement

South Dakota timeshare law prohibits any false advertising or advertising fraud under 58-33-5. No developers or sales agents may create, distribute, or issue any deceptive information to capture a sale under this timeshare law. In South Dakota it is also prohibited to make any dishonest or false statements in regards to the timeshare offering. Violation will result in a Class 2 misdemeanor.
