The Right to Cancel a Timeshare in Pennsylvania

According to the Attorney General of Pennsylvania, a purchaser has five days to cancel a timeshare contract. The purchaser must submit the request in writing in the form of a notice of cancellation to the seller. The seller must return all payments to the buyer within 10 days.

Timeshare Foreclosure

In Pennsylvania, the timeshare foreclosure laws are included under that of a mortgage. If the seller wishes to foreclose upon a delinquent lien or mortgage, they must begin the process by sending a notice to the purchaser. The lien must be at least 60 days past due. This notice must state that the purchaser’s mortgage is in default and that the buyer has 30 days to satisfy this debt. Under this timeshare law, in Pennsylvania this debt would include the entire mortgage to be due. In addition, only Judicial Foreclosure is available under Pennsylvania timeshare law.
