Regulations Governing Timeshare Offering Plans dictates the timeshare law in New York. This statue is constructed within Part 24 of Title 13 of New York Codes, Rules and Regulations (NYCRR). For these timeshare laws to apply to timeshares located out of New York, an offering plan must be filed to state.
How to Cancel a Timeshare Contract in NY
Under Section 24.3 of New York timeshare laws, a purchaser has the right to cancel a timeshare contract within seven business days on the date that the contract was engaged. This right to cancel cannot be waived. The seller may submit a notice to cancel the timeshare by mail to the seller. Under this timeshare law, the seller must refund all payments within 30 days.
Timeshare Advertising Laws
Section 24.6 states that timeshare advertisements in New York must contain a declaration that the item is being used for “The purpose of soliciting timeshare sales”. These advertisements include but are not limited to:
- Brochures
- Cards
- Mail Giveaways
- Radio and TV Advertisements
- Letters
Another sector of this timeshare law declares that if any maintenance fee charges are to be subject to changes, then advertisements must not speak in definite terms. Word such as “projected” or “estimated” must precede the charges.
