Timeshare law in Idaho is sanctioned under the Idaho Subdivided Land Disposition Act, 55-1801. The Idaho Real Estate Commission regulates timeshare development both within and outside of the state. Because the legislation in Idaho does not cover timeshare laws to the same extent as others, it is recommended that you seek legal counsel from a lawyer who is experienced in timeshare law with any disputes or claims in relation to timeshare.

How to Cancel a Timeshare in Idaho

A purchase has the right to cancel a timeshare contract by personally delivering or sending by certified mail, a written notice of cancellation to the subdivider for five days after execution of the contract. This right to contract cancellation must also be included in the initial contract.

Idaho Timeshare Fraud

Idaho Statute 55-1812 states that it is unlawful for any person to engage in any practices or acts that would be determined as deception, fraud, or misrepresentation towards a buyer of a subdivided land. Being that Idaho classifies timeshare as a subdivided land, timeshare buyers are protected against fraudulent companies in regards to timeshare sales and resale.

Timeshare Resale Laws in Idaho

According to Idaho Statute 55-1817, no person, salesperson, or real estate broker may sell a timeshare without proper licensing. Under this law, all timeshares in the state or sold within the state are included.
