Timeshare Laws in Ohio are regulated by the Ohio Revised Code 4735.25 and are governed under Ohio’s real estate laws. Therefore, the agency which deals with all timeshare proceedings would be the Ohio Department of Commerce Division of Real Estate and Professional Licensing.

Timeshare Advertising Scams

In Ohio it is unlawful for any advertiser, salesperson, or persons to partake in false or misleading advertising under Ohio Administrative Code 109:4-3-02. In attempts to eliminate timeshare scams they must also disclose any limitations or conditions to any offering. This also includes any online advertising, such as timeshare resale listings. In addition, under section 4735.30 no salesperson may make any false written or oral statements in regards to the timeshare contract or timeshare property.

Ohio Timeshare Cancellation

In Ohio, the timeshare cancelation right is a period of three days. The purchaser must submit a written notice to cancel the timeshare contract to the seller by mail within this time period. All funds must be returned to the purchaser shortly thereafter.

Timeshare Foreclosure

In Ohio, there is only judicial foreclosure available, meaning that the foreclosure must go through the court system. Under Ohio Revised Code 2323.06 and 2323.07, the court will notify the purchaser of the mortgage debt and give the owner 150 days to pay the debt or file a dispute against the timeshare resort.
